ICANN UDRP - Six Tips for Effective Advocacy to Win Domain Name Disputes

Domain name conflicts affecting business are on the rise.

Fortunately, victims of domain name abuse have an effective tool to fight cybersquatting. The Uniform Dispute Resolution Policy (UDRP) adopted in 1999 by the International Corporation for Assigned Names and Numbers (ICANN), the international body responsible for domain name governance, has been used to address thousands of domain name conflicts.

As an ICANN UDRP Panelist with over 125 reported decisions, I have read many submissions, some very good, many bad.

Here are six recommendations for UDRP submissions.

1. The Complaint (or Answer) should be a brief. This is your only chance to argue your position. Treat it like a memorandum in support of a motion for preliminary injunction or summary judgment by presenting your case as an advocate. Mere notice pleading allowed in our federal system is not effective for the circumstances.

2. The Pleading should be brief. Although the provider's limitations on length are largely ignored and exceeded, as a Panelist I urge you to remember that effective legal writing is brief and to the point.

3. The Pleadings should follow the Policy. Follow the elements of the Policy in stating your position. Remember that the Panel must address each of these issues. Make it easy for the Panel to decide in your favor by organizing your argument around each element of the claim or defense.

4. Support your position with proof. You need more than bald allegations to prove rights and bad faith, and you will find an increasing number of cases in which complainants are called upon to make additional submissions or lose their claim due to lack of proof. Strong submissions present evidence by way of exhibits and short affidavits. But don't merely shovel in piles of documents. Remember point 2.

5. Make good use of supporting authority. Give cases to support your argument and show why the cases are relevant. Avoid merely citing cases. There have been over 10,000 reported UDRP decisions. Don't assume the Panel knows the result and reasoning of each case you cite. Help the Panel by providing at least a parenthetical on the cases you cite.

6. Recognize the limits of the Policy. The Policy is designed to address cases of cybersquatting involving protectable trademarks. It is not intended for contract disputes, garden variety infringement cases, defamation claims, or personal names that are not entitled to commercial protection. Adverse decisions are often the result of claims that obviously stretch beyond the scope of the Policy. Matters outside the scope of the Policy are better directed to appropriate civil courts.

Since 1999, we have used the UDRP to help our clients recover hundreds of domain names from cybersquatters at a fraction of the cost of ordinary civil litigation. Used properly, the UDRP is an effective tool to aid businesses protect their interests in cyberspace.

Online Home Business - Select Products That People Will Use

If you are like most people doing online home business, then you are probably sick and tired of asking people for hundreds of dollars per month to purchase product of which 95% of them will never sell or use themselves.

When I originally started my online home business, the part that I hated was to ask friends and neighbors to join me as members and sell the products. I was sick and tired of asking people to buy the products that 99.99% of them will never get sold or cannot be used by the people who possess them.

In the beginning, I bought myself 100s of junk products that I thought I will be able to sell or find subscribers to it. Now they are in my back yard shed, collecting dust. I am talking about some stupid vitamins, household items, and what not. I found out that they were overpriced and no body really used them.

The part of the problem in this industry is most products are not affordable and they are not being used regularly in order for customers to keep coming back. This is why long-time online home business marketers often become fed-up and failed.

In order to be successful, especially in online home business, you need products that customers will actually use and will have to come back again and again month after month. The products have to be affordable. You cannot expect people to buy products that are overpriced. People know when a product is over priced.

The things I will look for before I jump into spending marketing dollars for any product in my online home business are: The product should be usable by the population, reasonably priced monthly payment to subscribe or to order, no shipping involved no hidden costs, no employees needed.

Another point I wanted to make is this- affordability has different meaning to different consumers. Therefore affordability depends on to which customer group you are marketing to. Like one of the products that I am selling is domain names. It is not that expensive. I target that mostly to ordinary population. On the other hand I also sell internet marketing tools for online home businesses. They are not that cheap. What I am getting at is affordability depends up on the products and to whom you are targeting the products.

There are 600 million Internet users, and more and more people daily are using their own web sites as a way to promote their online home business. I suggest you spend time on your research, come up with a product or products that p3eople are already looking for at a great price, and offers an outstanding business opportunity.

New Internet Marketers Building a Cash Machine Should Not Have a Newbie Mentality

After 2 months of learning and making mistakes, finally I am beginning to see some light and I want all new internet marketers to know. After setting up my first website, tossing and tuning, trying to make it the best website, I finally came to the conclusion that you should stop making it a beautiful webpage and starting writing good useful information.

All the effort from day one of knowing nothing, just purging my money into getting a domain, a domain name and then trying to develop a good webpage and finally, turning into a blog was worth the time.

So what is my message for mentioning the above?

My message is simple, just get down and start putting yourself into the frontline. I was inspired to write this article after the World Internet Summit in Singapore 2007.

I was approached by this stranger and she told me this is the second Internet summit. So out of curiosity, since its been a year since she attended the first internet summit, I was very excited to ask her about her website and the progress that she has so far, but sadly, all she told me is that she did not do anything yet.

She is still in the planning stage and has gathered 9 people to form a mastermind group to further "plan" on the direction they want to go. So I was curious, so I ask her why not start exploring first, she said the main person who knows how to setup the website is not around so all of them are waiting for him to come back.

My whole point here is this, you have to start taking action and not wait for this one person to appear and solve all your problems. That man has become their excuse not to proceed, and I would assume if nothing happens, they will just blame him for all the delays and starting up their website. Can you imagine 8 people waiting for just 1 person to start the show?

And one last point to take note, when you decide to embark on this journey as an internet marketer, it is time to take away the newbie tag and tell people "You" are ready to take on the big guns. If you always consider yourself as a newbie, which in my case study, after 1 year and she still consider herself a newbie, it is time to take responsibility for your actions and stop finding any more excuses not to start.

A Model for Network Marketing Success

To achieve network marketing success a viable plan or model is
absolutely critical. Having researched a number of different
models, I'm convinced that the most promising one is the Funded
Proposal. When the Funded Proposal is used in conjunction with
secondary sales and a strong primary product it can be extremely
powerful. Used correctly, these elements go a long way toward
ensuring network marketing success for those willing to invest
the effort necessary to learn the system and implement it
properly.

A "Funded Proposal" is simply a means of marketing an
informational (or other) product such as an ebook, course or
seminar to the suspect; convert them to a prospect, and to
generate income to fund future advertising. In addition, the
Funded Proposal helps to weed out the tire-kickers and brings a
much more serious prospect to the table thereby further
enhancing the probability of network marketing success.

The "secondary sale", also known by some internet marketers as
the back-end sale, comes into play once the prospect has been
qualified and is now a bon-fide customer. Network marketing
success becomes much easier when working with clients who have
made previous purchases. The secondary sale will normally take
the form of product or tool that will facilitate the new network
marketer in the development, management, or growth of their
business.

Since the Funded Proposal, by its design, has covered most, if
not all of the advertising and promotional expenses, the
secondary sale will help to ensure that all expenses have been
covered and that a break even position has been attained. In the
best case scenario some level of profitability has actually been
achieved.

The final step in assuring network marketing success is of
course choosing the right primary product and is extremely
important. The primary product will contribute the lion's share
of revenues and profitability. While it is beyond the scope of
this brief introduction to consider all of the factors that
should be considered in selecting a primary product, the most
important things to consider include choosing a product that has
broad appeal and provided by a company that has a proven track
record – from a management aspect, number of years in business
(at least 10 - 15), and profitability.

Sell Your Domains At The Best Places - Tips To Sell Domain Names

Looking to sell domain names? There are several tips you should follow to make sure you get the best deal you can when you sell domain names.

First, attempt to sell the domain name on your own. Use forums, such as Digital Point or DNForum, and write up a good post.Put it on the forums, and after awhile you will find some people interested in purchasing the domain. If you don't get the price you want though, don't worry, there are plenty of other options you can choose from. First, try and use a domain broker. However, consider this as a second option,because they will usually take a fee. If you still don't get the right price from a broker, I recommend you go back to theseforums and try a different sales approach. For example, if you didn't put the domain name in the post where you were trying to sell domain names, you may have attracted less views to it. Put the domain name in the post. If you put the starting price at $50, drop it down to $10. The more bids you get, the better your post looks. Would you rather choose a post with 10 replies or one with 50 replies? The hotter your post is, the more potential buyers you may have.

My last suggestion would be to attempt to sell domain names on eBay. Although eBay takes a small fee, there are so many people out there that you may find the right person to sell domain names to. If you are set on a fixed price, make sure to choose a fixed price format, instead of auction format. Remember, if you put it up for auction and don't end up getting the price you want, you are still obligated to sell the item. All in all, I suggest that you be patient when you sell domain names. Just because no one wants to buy it now, doesn't mean they won't want to buy it in 3 weeks. Just know that there is always someone out there who is ready to buy your domain name, you just need to find them.

Internet Marketing Tips - Ways To Market Your Site Offline

I know that its an online business you are doing or its an online business you want to establish but online marketing is not the only way to advertise your business. There are a number of offline methods that will give you targeted traffic. Offline is not the most effective way of marketing, however, it can give you additional traffic.

You can speak at gatherings such as seminars or functions. You can talk about your business and what you offer on your website. it's a good way to get word out about your business.

There is also business cards which you can include your site url and distribute around. You can go to seminars for instance which are about your area of specialty and network with people there making sure that each time you give them your card. If they are interested to find out more they can then look you up on the internet.

There is the newspaper through the classifieds. You can advertise your online business in your local paper for instance or even the national paper depending on your budget. However, be careful start small and first make sure this actually effective in getting you quality traffic. Before you go all out make sure that it is worth the cost.

An obvious way is to tell your family and friends. You can have honest reviews from them. You never know they might even pass on your link to other people. Referrals are always beneficial. It doesn't hurt and usually just takes 1 group email anyway.

If you are not on a tight budget trade publications are not a bad way to go. They allow you to publish your business for a price of course.

Another way to promote your business is through promotions. For instance you can promote a seminar about your subject and offer promotional items for people to get for free. Your business site will be on the items so that people can check you out when they get you home.

These are ways through which you can gain more traffic. They are definitely not as effective as online methods but they do not hurt to give them a go.
